The rising costs of labor, materials and goods have led to lower profits and increased debt for many small business owners, leading many to consider whether bankruptcy may provide a solution. This program will provide a general overview of the bankruptcy process and general factors that small business owners may consider when deciding whether to file bankruptcy or pursue other avenues of managing business debt. The program will also cover strategies for small business owners to protect their personal income and assets from creditors of their business. Finally, the program will discuss what a small business may be able to do to protect its financial interests when a customer, vendor, partner or other business counterparty files bankruptcy or is not paying its debts.

Joseph R. Dunn is a seasoned bankruptcy attorney and creditor-rights litigator. Joe’s broad-ranging restructuring and litigation practice draws on significant experience with complex bankruptcy cases, creditor rights litigation, bankruptcy litigation, and other work in insolvency scenarios. Joe has advised numerous public and private company Boards, committees and executive management teams regarding insolvency issues, guiding those clients through workouts, debt restructurings and insolvency proceedings. Joe has additionally served in various leadership roles in local and statewide insolvency organizations, including on the Advisory Board for ABI’s Battleground West conference, the Board of California Bankruptcy Forum, and on the Selection Committee for the Ninth Circuit’s Lawyer Representative Program.
